General Terms and Conditions

1. GENERAL
www.latabatiere.ch is operated by La Tabatière Sàrl, Bvd de Pérolles 26, CH-1700 Fribourg.

These General Terms and Conditions (hereinafter referred to as “GTC”) govern the relationship between customers and www.latabatiere.ch.
By placing an order, the customer agrees to the GTC in force at the time of ordering.

2. PROTECTION OF MINORS
In accordance with Swiss law, alcoholic beverages may not be sold to persons under the age of 16, and spirits may not be sold to persons under the age of 18.
We do not sell tobacco products to persons under the age of 16.
By placing an order on www.latabatiere.ch, the customer confirms that they are legally entitled to purchase such products.
La Tabatière Sàrl declines any liability in the event of non-compliance.

3. SALES RESTRICTIONS
La Tabatière Sàrl reserves the exclusive right to enforce sales restrictions.
Even if www.latabatiere.ch accepts an order and payment, La Tabatière Sàrl may subsequently limit the quantity ordered.
Any payment made will be refunded within 5 working days in proportion to the reduced order amount.
No claims for damages or loss of profit may be asserted by the customer.

4. VOUCHERS
Vouchers may only be redeemed in-store at
La Tabatière, Bvd de Pérolles 26, 1700 Fribourg.

5. DATA PROTECTION
Only data necessary for processing orders and payments are collected.
Personal customer data are treated confidentially in accordance with applicable data protection legislation and are neither passed on to third parties nor used or sold for third-party advertising purposes.

6. SECURITY OF ELECTRONIC PAYMENTS
Sensitive data are transmitted in encrypted form.
The security of electronic payment transactions is a top priority, and the encryption technologies used comply with current international standards.

7. PRICES
All prices are stated per item in CHF and include the applicable statutory value-added tax (VAT).
Price changes and time-limited promotions may occur at any time without prior notice.

8. PAYMENT TERMS
Payment may be made via TWINT, PayPal, advance payment, or — in the case of in-store collection — payment in the boutique.

9. DELIVERY TERMS
Delivery is carried out after receipt of the order and payment, to the billing address or to an alternative delivery address specified by the customer.
Deliveries to multiple recipients require separate orders.
Delivery generally takes place within 2 to 3 working days following receipt of payment.
If an order cannot be delivered, the customer will be informed without delay and any payment made will be refunded within 5 working days.
Claims for damages or loss of profit are excluded.

10. PACKAGING AND SHIPPING
Packaging and shipping costs within Switzerland and the Principality of Liechtenstein are variable for orders under CHF 500.– (excluding VAT).
For orders exceeding CHF 500.– (excluding VAT), no packaging or shipping costs apply.
La Tabatière Sàrl determines the appropriate packaging and shipping method for each order.

11. AVAILABILITY
Products listed on www.latabatiere.ch are generally in stock and available for immediate delivery.
Should a product be temporarily or permanently unavailable, the customer will be informed as soon as possible.
Changes to availability and product range are expressly reserved.

12. DEFECTS / EXCHANGES / RETURNS
All orders placed on www.latabatiere.ch are binding.

No claims may be made regarding external packaging (tubes, original boxes, etc.).
As a rule, the product description shall prevail over illustrations.

Ordered products cannot be exchanged or returned, except in cases of incorrect delivery or damage incurred during transport.
The customer must check the delivery for accuracy and completeness upon receipt.
Any complaints must be submitted in writing within 5 days of receipt.
If no complaint is made within this period, the delivery shall be deemed accepted and free of defects.

In the event of a return, the customer bears all risks, in particular transport risk, until the goods are received by La Tabatière Sàrl.
Recognised defects will be reimbursed up to the amount of standard postal return costs.
If a product ordered and paid for is not available within four weeks, the customer may request a refund of the purchase price.
Claims for damages or loss of profit are excluded.

13. VALIDITY OF THE GTC
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.
These GTC may be amended at any time without prior notice.

14. JURISDICTION
All contractual relationships are governed exclusively by Swiss law.
The place of jurisdiction is Fribourg.
